Patents
A new invention in the modern day deserves recognition and can achieve this and much more through the registration of a patent. For an idea to be eligible for patent it must satisfy the following criteria:
- It must be Novel (New);
- It requires a certain level of inventiveness (the Inventive Step);
- It must have some form of industrial applicability.
Upon registering a patent, one will have total ownership of the invention. Nobody will be able to make any financial gains on the invention without the permission of the patent owner. Apart from giving certainty that an invention belongs to you, a patent under Maltese law gives its owner the right to do or authorise the following actions:
- making products involving the subject matter of the patent.
- offering or the putting a product on the market based on the substance of the patent along with the use of such product, or the importation or stocking of such product where the purpose will be to put it on the local market.
- inducing any person to perform any of the above.
Registering a patent will give the person all of the above rights in the Maltese territory. Patents effectively give you a monopoly over the invention for as long as you own the patent rights. This is why it is important to register an idea immediately before somebody else does.
