Employment Lawyer

Job Purpose

Forming part of the Employment and Immigration Team  you will be involved with advising on, structuring and handling a wide spectrum of transactions which will include the employment and immigration aspect of legal due diligences, contract negotiating, drafting and review, day-to-day advice on employment related matters, drafting of employment policies, TUPEs, redundancies and collective redundancies and disciplinary measures, working very closely with the senior associates and partners responsible for the clients or tasks at hand. In the performance of your professional duties, you will be exposed to a wide variety of businesses undertakings, both local and foreign-controlled. 

Job duties and responsibilities

– Advising on a wide spectrum of employment issues
– Contract drafting and review, assisting clients in reviewing and negotiating employment contracts
– Advising on disciplinary matters, including forming part of independent disciplinary boards
– Whistleblower protection, support and protect whistleblowers, ensuring their rights are safeguarded
– Drafting and amending policies and procedures for clients
– Contributing to legal due diligence exercises
– Advising on more complex TUPE, redundancy and collective redundancy measures
– Client representation in any Industrial Tribunal cases
– Legal research and analysis, staying abreast of employment laws and regulations to ensure accurate and up-to-date legal advice
– Organizing engagements and workflows
– Leading and co-ordinating business development initiatives
– Managing client relationships
– Keeping abreast of legal and regulatory developments in the employment sphere
– Developing and contributing towards the development of the organization’s knowledge base, by giving on-the job training, participating in academic initiatives and publishing articles and analyses
– Developing and contributing towards the organisation’s traineeship and young lawyer programme through mentoring and training initiatives

AML/CFT Executive

The AML/CFT Executive shall primarily be responsible for:

  • Supporting the Head of Compliance and MLRO in the following functions:
    • Carrying out relevant risk assessments in respect of the Company’s operations and business to identify the Company’s exposure to ML/TF risks and identifying measures through which such exposure can be mitigated;
  • Setting-up the Company’s AML/CFT, Compliance and Risk Management Programmes, aimed at establishing the policies and procedures to be implemented by the Company, and continuously updating said Programmes to ensure that they are in line with any developments which may take place;
  • Delivering AML/CFT and other compliance-related training to the Company’s employees;
  • Acting as a point of contact and information for other departments in order to understand their needs and ensure that they are well-equipped in order to execute their obligations in the Company’s AML/CFT Programme;
  • Preparing periodic AML/CFT and compliance reports for presentation to the Board of Directors;
  • Preparing external reports and returns to be submitted to the relevant regulatory or other authorities in line with the Company’s compliance and AML/CFT obligations;
  • Generally ensuring that the Company’s business operations are conducted in a manner which is compliant with any applicable laws, regulations, professional standards, accepted business practices and internal standards from an AML/CFT perspective;
  • Assuming an active role in the client onboarding process being carried out in regard to prospective clients, particularly from a risk assessment, client screening and customer due diligence perspective;
  • Carrying out ongoing monitoring from an AML/CFT perspective on existing clients, as and when this is deemed to be necessary;
  • Carrying out transaction monitoring from an AML/CFT perspective, and when this is deemed to be necessary;
  • Carrying out research on an ongoing basis into the relevant AML/CFT and other regulatory legislation and regulations which may be applicable to the Company and its operations;
  • Supporting other members of the AML/CFT and Compliance team in the carrying out of any AML/CFT-related functions and duties, particularly by offering guidance and support to client onboarding team members with their day-to-day responsibilities and work;
  • Generally assisting the MLRO and Head of Compliance with the day-to-day responsibilities from an AML/CFT, compliance and regulatory perspective.

Requirements:

  • Degree Level of education or equivalent.
  • At least two years experience working in a similar role;
  • Knowledge of the Corporate industry regulations and practices;
  • Knowledge in Due diligence & AML functions & practices;
  • Proficient in the use of Office Applications;
  • Analytical and investigative skills;
  • Good report writing skills;
  • Capable of presenting findings in written and oral format;
  • Good command of the English language (both written and spoken);
  • Ability to manage multiple tasks and meeting deadlines.
  • Able to work independently as well as in a team;
  • Attention to detail;
  • Ability to take ownership; and
  • Have a strong working knowledge of AML/CFT Laws and Regulations applicable in Malta.
